Objekt i kontrate p\u00ebr sh\u00ebrbime \u00ebsht\u00eb p\u00ebrcaktimi i t\u00eb drejtave dhe detyrimeve t\u00eb pal\u00ebve kontraktuese lidhur me ofrimin e sh\u00ebrbimeve t\u00eb Telkos. P\u00ebrdoruesi zgjedh pakon e sh\u00ebrbimit dhe specifikat e pakove. Kontrata \u00ebsht\u00eb p\u00ebrpiluar n\u00eb p\u00ebrputhje me Ligjin Nr. 04\/L-109 p\u00ebr Komunikimet Elektronike, Rregulloren Nr.005\/B\/24 p\u00ebr Kontratat, Transparenc\u00ebn dhe Publikimin e Informatave dhe Masave t\u00eb tjera Mbrojt\u00ebse p\u00ebr P\u00ebrdoruesit Fundor\u00eb t\u00eb Sh\u00ebrbimeve t\u00eb Komunikimeve Elektronike, Rregulloren Nr. 2024\/02 p\u00ebr Mbrojtjen e P\u00ebrdoruesve n\u00eb Fush\u00ebn e Sh\u00ebrbimeve Mediale Audio dhe Audiovizuele si dhe legjislacionin tjet\u00ebr t\u00eb aplikuesh\u00ebm i cili e rregullon fush\u00ebn p\u00ebr t\u00eb cil\u00ebn lidhet kjo kontrat\u00eb.<\/p><p>1.2. N\u00ebnshkrimi i kontrates b\u00ebhet n\u00eb zyrat e Operatorit, por n\u00eb raste t\u00eb ve\u00e7anta, pal\u00ebt mund ta n\u00ebnshkruajn\u00eb edhe jasht\u00eb zyrave t\u00eb Operatorit ose n\u00eb distanc\u00eb, p\u00ebrmes mjeteve t\u00eb q\u00ebndrueshme t\u00eb komunikimit elektronik, me kusht q\u00eb t\u00eb p\u00ebrmbushen k\u00ebrkesat p\u00ebr informim dhe transparenc\u00eb t\u00eb parashikuara me legjislacionin n\u00eb fuqi.<\/p><p>1.3. Kontrata mund t\u00eb n\u00ebnshkruhet edhe n\u00eb m\u00ebnyr\u00eb elektronike, p\u00ebrmes \u00e7do forme t\u00eb identifikimit t\u00eb besuesh\u00ebm dhe konsiderohet ligj\u00ebrisht e vlefshme n\u00eb p\u00ebrputhje me Ligjin Nr. 08\/L-022 p\u00ebr Identifikimin Elektronik dhe Sh\u00ebrbimet e Besuara n\u00eb Transaksionet Elektronike.<\/p><ol start=\"2\"><li>Payments and Billing<\/li><\/ol><p>2.1. Monthly package tariffs, promotional offers and any price changes are published on the Operator's official website: <a href=\"http:\/\/www.telkos.net\/en\/\">www.telkos.net<\/a>.<\/p><p><strong>2.2.<\/strong> All monthly financial obligations are invoiced at the beginning of each month. <strong>period of use<\/strong>, which lasts thirty (30) calendar days and <strong>starts from the date of signing this contract<\/strong>, regardless of the time when the User actually starts using the service. Each subsequent period is calculated in a regular monthly cycle, from the respective effective date. All prices are expressed in gross value and include Value Added Tax (VAT), except in cases where the User benefits from a tax exemption under the law. Invoicing is made in the official currency, euro (\u20ac). Payment can be made through the online platform of <strong>Telkos<\/strong>, at Telko branches, through authorized distributors or through bank transfers to these accounts: PCB\u20131181003016000169; NLB\u20131701017600081503; RBKO\u2013 1501001018842342; TEB\u20132020000165955532; BPB\u20131300001002643983; BKT-1901005902031165; BE\u2013 1401000100270631; Pribank \u20132410130100019239; Paysera \u20135200001549570014.<\/p><p>2.3. If the User does not fulfill the payment obligations within the specified deadlines, the services are terminated immediately, with warning, while the obligation continues in accordance with the contractual period, determined by this contract.<\/p><p>2.4. In the event that the competent authorities impose tariffs, taxes or other fiscal charges that affect the prices of services provided by the Operator, <strong>The user agrees to pay the additional amount applied.<\/strong>In these circumstances, the Operator has the right to <strong>increase the price of services only by the value of the imposed change<\/strong>, provided that the User is notified in advance, in accordance with the deadlines and procedures set forth in the applicable consumer protection legislation.<\/p><p>2.5. If the User changes the package, while having made a prepayment, and Telkos has fulfilled the terms of the contract, the remaining days of the prepayment are not compensated.<\/p><p>2.6. In cases where <strong>User<\/strong>, after the realization of <strong>payment, <\/strong>requests service interruption <strong>before the end of the contracted period<\/strong>, while <strong>The operator has fulfilled its obligations under the contract.<\/strong>, prepaid amount <strong>not subject to refund<\/strong>.<\/p><p>2.7. \u00c7do ndryshim i k\u00ebsaj kontrate mund t\u00eb b\u00ebhet vet\u00ebm n\u00eb form\u00ebn e nj\u00eb aneksi t\u00eb kontrat\u00ebs.<\/p><p><strong>2.8. \u00c7mimet e elementeve individuale <\/strong>p\u00ebr sh\u00ebrbimin e internetit jan\u00eb si vijon<strong>: <\/strong>Pako Basic M &#8211; Internet 18\u20ac; Tv &#8211; 18\u20ac;\u00a0Pako Basic L &#8211; Internet 24\u20ac, Tv 18\u20ac;\u00a0Pako Olympic M &#8211; Internet 29\u20ac, Tv 18\u20ac;\u00a0Pako Premium Olympic &#8211; Internet 32\u20ac, Tv 18\u20ac.<\/p><p>2.9. Pas realizimit t\u00eb pages\u00ebs vjetore t\u00eb kontrat\u00ebs nga ana e P\u00ebrdoruesit, p\u00ebr periudh\u00ebn dymb\u00ebdhjet\u00eb (12) mujore t\u00eb sh\u00ebrbimit, Operatori i ofron P\u00ebrdoruesit nj\u00eb (1) muaj shtes\u00eb t\u00eb sh\u00ebrbimit pa pages\u00eb. Muaji shtes\u00eb pa pages\u00eb aktivizohet pas pranimit t\u00eb pages\u00ebs vjetore nga Operatori dhe nuk i faturohet P\u00ebrdoruesit.<\/p><ol start=\"3\"><li>Reporting technical problems<\/li><\/ol><p>3.1. In case of problems with the internet service or television signal, the User is obliged to immediately notify the Operator's Technical Center. Telkos is committed to intervene to resolve the problem within a period of 24 to 96 hours, depending on the nature of the defect.<\/p><p>3.2. The Operator's Technical Center is available to the User 24\/7 and can be contacted via the numbers: +383 44 100 995, +383 600 321, or via the electronic address: <a href=\"mailto:info@telkos.net\">info@telkos.net<\/a>.<\/p><p>3.3. The operator considers them as <strong>service interruption<\/strong> only those defects that originate from its central infrastructure (backbone).<\/p><p>3.4. The User is obliged to provide unhindered physical access for the Operator's technical staff to the location where the Operator's equipment is located, for the purpose of inspection, maintenance and troubleshooting.<\/p><p>3.5. If the Operator's access to the equipment location is obstructed by third parties, the Operator shall not be liable for the interruption or inability to resolve the defect. The resolution of obstacles arising from third parties is the responsibility of the User.<\/p><ol start=\"4\"><li>Service Quality and Technical Defects<\/li><\/ol><p>4.1. P\u00ebr sh\u00ebrbimin e internetit or\u00ebt e pikut konsiderohen intervali kohor nga ora 19:00 deri n\u00eb 23:00. The operator provides the service of broadcasting television channels in formats <strong>HD (High Definition)<\/strong> and <strong>SD (Standard Definition)<\/strong>, in accordance with the original format received from the broadcasting source and agreements with the rights holders. Audio format (<em>audio)<\/em> transmitted in standards <strong>MPEG<\/strong> and <strong>ADTS<\/strong>, depending on the technical availability of the content.<\/p><ol start=\"5\"><li>Operator Rights and Obligations<\/li><\/ol><p>5.1. Operatori \u00ebsht\u00eb i obliguar t\u2019i ofroj\u00eb P\u00ebrdoruesit sh\u00ebrbime t\u00eb cil\u00ebsis\u00eb s\u00eb lart\u00eb, n\u00eb p\u00ebrputhje me kushtet p\u00ebr t\u00eb cilat pajtohen pal\u00ebt n\u00eb kontrat\u00eb. N\u00ebse Operatori nuk p\u00ebrmbush obligimet p\u00ebr ofrimin e sh\u00ebrbimeve t\u00eb internetit dhe televizionit, kompensimi do t\u00eb b\u00ebhet sipas legjislacionit n\u00eb fuqi. N\u00eb rast t\u00eb nd\u00ebrprerjes s\u00eb sh\u00ebrbimit p\u00ebr nj\u00eb periudh\u00eb prej t\u00eb pakt\u00ebn 12 or\u00ebsh, P\u00ebrdoruesi do t\u00eb kompensohet me 24 or\u00eb zgjatje sh\u00ebrbimi p\u00ebr \u00e7do periudh\u00eb prej 12 or\u00ebsh t\u00eb humbur, n\u00ebse problemi \u00ebsht\u00eb raportuar dhe dokumentuar. P\u00ebrdoruesi duhet t\u00eb ket\u00eb prova t\u00eb nevojshme p\u00ebr t\u00eb k\u00ebrkuar kompensim. K\u00ebrkesa p\u00ebr kompensim duhet t\u00eb dor\u00ebzohet me shkrim, jo m\u00eb von\u00eb se 30 dit\u00eb nga data e nd\u00ebrprerjes s\u00eb raportuar. Kompensimi b\u00ebhet duke zgjatur vlefshm\u00ebrin\u00eb n\u00eb var\u00ebsi t\u00eb llojit t\u00eb sh\u00ebrbimit ose pakos.<\/p><p>5.2. Me njoftim paraprak, Telkos rezervon t\u00eb drejt\u00ebn t\u00eb nd\u00ebrpres sh\u00ebrbimin p\u00ebr arsye mir\u00ebmbajtjeje dhe avancimi t\u00eb rrjetit. Nd\u00ebrprerjet e planifikuara mund t\u00eb zgjasin p\u00ebr aq koh\u00eb sa zgjasin punimet.<\/p><p>5.3. The User agrees that Telkos bears no responsibility for financial losses, loss of income, loss of data or other damages, direct or indirect, that may result from the interruption, lack or poor quality of the internet service, for any reason.<\/p><p>5.4. The User agrees that Telkos may contact the User via telephone numbers (including SMS), email address, postal address, provided in the contract by the User, for service-related issues.<\/p><p>5.5. The User bears full responsibility for the accuracy, truthfulness and updating of the contact data provided by him. In case of providing incorrect or untrue information, the User bears responsibility for all consequences that may result.<\/p><p>5.6. Lista e kanaleve televizive mund t\u00eb ndryshoj\u00eb var\u00ebsisht rrethanave komerciale, teknike dhe marr\u00ebveshjeve me bart\u00ebsit e t\u00eb drejtave. N\u00eb k\u00ebto raste Telkos nuk mban p\u00ebrgjegj\u00ebsi p\u00ebr shtimin apo largimin e ndonj\u00eb kanali televiziv.<\/p><p>5.7. Operatori ka t\u00eb drejt\u00eb t\u00eb nd\u00ebrmarr\u00eb masa t\u00eb menj\u00ebhershme dhe t\u00eb p\u00ebrkohshme p\u00ebr t\u00eb mbrojtur integritetin dhe sigurin\u00eb e rrjetit dhe sh\u00ebrbimeve, p\u00ebrfshir\u00eb, por pa u kufizuar n\u00eb:bllokimin e p\u00ebrkohsh\u00ebm t\u00eb trafikut nga ose drejt nj\u00eb adrese IP-je specifike q\u00eb dyshohet se \u00ebsht\u00eb burim i nj\u00eb sulmi kibernetik ose aktiviteti t\u00eb paligjsh\u00ebm si dhebllokimin e p\u00ebrkohsh\u00ebm t\u00eb aksesit drejt domeneve t\u00eb identifikuara si burim i p\u00ebrmbajtjes s\u00eb d\u00ebmshme ose aktivitetit t\u00eb paligjsh\u00ebm.<\/p><ol start=\"6\"><li>User Rights and Obligations<\/li><\/ol><p>6.1. The User is obliged to use the services provided by the Operator in accordance with the terms of this contract and the applicable legislation. The User agrees to use the service only for personal, residential purposes. Any use of the service for business purposes constitutes a serious breach of the contractual terms.<\/p><p>In case of violation, Telkos may warn the User to use the service in accordance with the terms of the contract, suspend or automatically cancel the service provided by Telkos without any obligation for compensation to the User and request compensation for damages caused by the misuse made by the User. If the contract is canceled by Telkos for reasons provided for in this article, the User remains liable for all remaining financial obligations to the Operator.<\/p><p>6.2. Any persistent or repeated discrepancy between the actual quality of the User's service and the standards set out in the contract, entitles the User to take legal measures, in accordance with the legislation in force. The User must inform Telkos of the discrepancy. If Telkos does not rectify the discrepancy within 15 days, the User has the right to file a complaint with the RAEPC (Regulatory Authority for Electronic and Postal Communications).<\/p><p>6.3. N\u00ebse P\u00ebrdoruesi ndryshon adres\u00ebn e banimit, obligohet t\u00eb shlyej t\u00eb gjitha detyrimet financiare q\u00eb ka ndaj Telkos deri n\u00eb dit\u00ebn e fundit t\u00eb sh\u00ebrbimit n\u00eb adres\u00ebn e vjet\u00ebr si dhe t\u00eb paguaj tarif\u00ebn e instalimit n\u00eb adres\u00ebn e re, n\u00eb vler\u00eb prej dhjet\u00eb (10) \u20ac, n\u00ebse Telkos mund t\u00eb ofroj\u00eb sh\u00ebrbim n\u00eb at\u00eb lokacion. P\u00ebr zhvendosjen e sh\u00ebrbimit brenda s\u00eb nj\u00ebjt\u00ebs nj\u00ebsi, aplikohet tarif\u00eb prej pes\u00eb (5) \u20ac. Telkos nuk mban p\u00ebrgjegj\u00ebsi n\u00ebse sinjali nuk \u00ebsht\u00eb i disponuesh\u00ebm n\u00eb adres\u00ebn e re t\u00eb P\u00ebrdoruesit.<\/p><p>6.4. Removal or interruption of the transmission of channels whose content is contrary to the constitutional order, in accordance with decisions of the competent authorities, does not constitute a reason for unilateral termination of the contract by the User.<\/p><ol start=\"7\"><li>Hyrja n\u00eb fuqi, koh\u00ebzgjatja dhe nd\u00ebrprerja e kontrat\u00ebs<\/li><\/ol><p>7.1. Kjo kontrat\u00eb hyn dhe mbetet n\u00eb fuqi p\u00ebr periudh\u00ebn e caktuar n\u00eb faqen e par\u00eb t\u00eb saj. Kontrata parashikon zgjatje automatike, me njoftim tridhjet\u00eb (30) dit\u00eb p\u00ebrpara. Pas nj\u00eb zgjatjeje t\u00eb till\u00eb P\u00ebrdoruesi ka t\u00eb drejt\u00eb t\u00eb p\u00ebrfundoj\u00eb kontrat\u00ebn n\u00eb \u00e7do koh\u00eb, me nj\u00eb afat njoftimi prej s\u00eb paku pes\u00eb (5) dit\u00ebsh para dat\u00ebs s\u00eb p\u00ebrfundimit, pa kosto shtes\u00eb.<\/p><p>7.2. Kontrata mund t\u00eb nd\u00ebrpritet n\u00eb rast t\u00eb mosrespektimit apo shkeljeve t\u00eb\u00a0 kushteve t\u00eb saj nga cilado pal\u00eb. Nd\u00ebrprerja e kontrat\u00ebs n\u00eb munges\u00eb t\u00eb provave t\u00eb qarta dhe v\u00ebrejtjeve t\u00eb dh\u00ebna me shkrim nga pal\u00ebt konsiderohet e paligjshme.<\/p><p>7.3. N\u00ebse P\u00ebrdoruesi e nd\u00ebrpret kontrat\u00ebn me afat t\u00eb caktuar para periudh\u00ebs kohore t\u00eb r\u00ebn\u00eb dakord, ofruesi i sh\u00ebrbimit mund t\u00eb k\u00ebrkoj\u00eb kompensim p\u00ebr p\u00ebrfundimin e parakohsh\u00ebm t\u00eb kontrat\u00ebs gjat\u00eb n\u00ebnt\u00eb (9) muajve t\u00eb par\u00eb kur kontrata \u00ebsht\u00eb lidhur p\u00ebr dymb\u00ebdhjet\u00eb (12) muaj, p\u00ebrkat\u00ebsisht dymb\u00ebdhjet\u00eb (12) muajt e par\u00eb kur kontrata \u00ebsht\u00eb lidhur p\u00ebr nj\u00ebzet e kat\u00ebr (24) muaj.<\/p><p>7.4. N\u00ebse P\u00ebrdoruesi ka abonim dhe nuk e ka shfryt\u00ebzuar sh\u00ebrbimin, nuk ka t\u00eb drejt\u00eb t\u00eb k\u00ebrkoj\u00eb kompensim p\u00ebr periudh\u00ebn e pashfryt\u00ebzuar.<\/p><p>7.5. P\u00ebrdoruesi ka t\u00eb drejt\u00eb t\u00eb shk\u00ebpus\u00eb kontrat\u00ebn pa kosto shtes\u00eb n\u00ebse Telkos ka d\u00ebshtuar t\u00eb p\u00ebrmbush\u00eb kushtet e kontrat\u00ebs, ka nd\u00ebrprerje t\u00eb platformave t\u00eb ndryshme brenda Telkos, gjegj\u00ebsisht nuk mund t\u00eb ofroj\u00eb sh\u00ebrbime sipas kontrat\u00ebs q\u00eb jan\u00eb pajtuar pal\u00ebt, p\u00ebrve\u00e7 n\u00ebse ndryshimet e propozuara jan\u00eb n\u00eb dobi t\u00eb P\u00ebrdoruesit, jan\u00eb t\u00eb nj\u00eb natyre administrative, nuk kan\u00eb efekt negativ te P\u00ebrdoruesi si dhe vendosen drejtp\u00ebrdrejt nga ligji ose vendimet e organeve shtet\u00ebrore. <strong>K\u00ebrkesa e P\u00ebrdoruesit<\/strong> duhet t\u00eb mb\u00ebshtetet me d\u00ebshmi t\u00eb paraqitura nga vet\u00eb P\u00ebrdoruesi, nd\u00ebrsa gjendja faktike e sh\u00ebrbimeve duhet t\u00eb konstatohet dhe verifikohet nga Operatori. Vet\u00ebm pas konstatimit dhe verifikimit nga Operatori, P\u00ebrdoruesi mund t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn p\u00ebr shk\u00ebputjen e kontrat\u00ebs pa kosto shtes\u00eb. T\u00eb gjitha ndryshimet e propozuara nga Telkos do t\u2019i d\u00ebrgohen P\u00ebrdoruesit t\u00eb pakt\u00ebn tridhjet\u00eb (30) dit\u00eb para hyrjes n\u00eb fuqi t\u00eb atyre ndryshimeve. N\u00ebse P\u00ebrdoruesi nuk pajtohet me ndryshimet ka t\u00eb drejt\u00eb t\u00eb nd\u00ebrpres kontrat\u00ebn brenda dy (2) muajve pas ndryshimeve. N\u00eb k\u00ebt\u00eb rast ai obligohet t\u00eb njoftoj\u00eb Telkos dhe t\u00eb paguaj\u00eb detyrimin e papaguar p\u00ebr sh\u00ebrbimin e marr\u00eb deri n\u00eb dat\u00ebn e shk\u00ebputjes s\u00eb kontrat\u00ebs.<\/p><p>7.6. N\u00ebse P\u00ebrdoruesi e nd\u00ebrpret kontrat\u00ebn para periudh\u00ebs kohore t\u00eb p\u00ebrcaktuar me kontrat\u00eb, kur Telkos ka ofruar sh\u00ebrbim n\u00eb p\u00ebrputhje me kushtet e kontrat\u00ebs, P\u00ebrdoruesi obligohet t\u00eb paguaj\u00eb tarif\u00ebn e shk\u00ebputjes s\u00eb parakohshme n\u00eb vler\u00eb prej 50\u20ac p\u00ebr shk\u00ebputjet n\u00eb gjasht\u00eb mujorin e par\u00eb t\u00eb kontrat\u00ebs 12 mujore dhe 30\u20ac p\u00ebr shk\u00ebputjet n\u00eb tremujorin e tret\u00eb t\u00eb kontrat\u00ebs dymb\u00ebdhjet\u00eb mujore. N\u00eb t\u00eb kund\u00ebrt\u00ebn Telkos do t\u00eb inicioj\u00eb procedur\u00eb p\u00ebrmbarimore p\u00ebrmes p\u00ebrmbaruesit privat. T\u00eb gjitha shpenzimet e krijuara me k\u00ebt\u00eb rast do t\u2019i bart\u00eb P\u00ebrdoruesi.<\/p><p>7.7. Operatori ka t\u00eb drejt\u00eb t\u00eb nd\u00ebrpres\u00eb kontrat\u00ebn pa paralajm\u00ebrim n\u00ebse P\u00ebrdoruesi kryen ndonj\u00ebr\u00ebn nga k\u00ebto veprimtari: e rishet sh\u00ebrbimin; e p\u00ebrdor sh\u00ebrbimin, drejtp\u00ebrdrejt ose t\u00ebrthorazi, p\u00ebr q\u00ebllime t\u00eb jasht\u00ebligjshme; lidh\u00eb pajisje ose kabllo t\u00eb paautorizuara n\u00eb pajisjet ose rrjetin e sh\u00ebrbimit; d\u00ebrgon, komunikon ose ruan t\u00eb dh\u00ebna, informata apo materiale q\u00eb jan\u00eb n\u00eb kund\u00ebrshtim me legjislacionin n\u00eb fuqi; e p\u00ebrdor sh\u00ebrbimin n\u00eb m\u00ebnyr\u00eb q\u00eb shkakton mosfunksionim t\u00eb sistemit; dob\u00ebsim t\u00eb cil\u00ebsis\u00eb ose rrezikim t\u00eb siguris\u00eb s\u00eb rrjetit;\u00a0 e shfryt\u00ebzon sh\u00ebrbimin p\u00ebr aktivitete t\u00eb paligjshme apo t\u00eb pamoralshme; e p\u00ebrdor sh\u00ebrbimin p\u00ebr komunikime t\u00eb natyr\u00ebs k\u00ebrc\u00ebnuese, ofenduese, ngacmuese, shpif\u00ebse apo t\u00eb pahijshme; e p\u00ebrdor sh\u00ebrbimin duke shkelur privat\u00ebsin\u00eb apo t\u00eb drejtat e pron\u00ebsis\u00eb intelektuale t\u00eb pal\u00ebve t\u00eb treta; krijon k\u00ebrc\u00ebnim serioz p\u00ebr rendin dhe sigurin\u00eb publike; shkakton d\u00ebme fizike ose materiale Operatorit ose pal\u00ebve t\u00eb treta; nd\u00ebrhyn n\u00eb funksionalitetin e rrjetit; p\u00ebrpiqet t\u00eb thyej\u00eb sistemet e siguris\u00eb s\u00eb rrjetit; pajisja e tij nuk ndalon s\u00eb shkaktuari shqet\u00ebsime teknike.<\/p><ol start=\"8\"><li>Equipment<\/li><\/ol><p>8.1. The equipment installed by the Operator for use is the property of the Operator, loaned to the User, for the period of use under this contract, unless the User expresses a willingness to purchase such equipment. The price of the modem is sixty (60) \u20ac, the price of the receiver is sixty (60) \u20ac.<\/p><p>8.2. N\u00eb rast t\u00eb p\u00ebrfundimit apo nd\u00ebrprerjes s\u00eb kontrat\u00ebs, P\u00ebrdoruesi obligohet t\u00eb kthej\u00eb pajisjet tek Operatori brenda pes\u00eb (5) dit\u00ebve nga data e nd\u00ebrprerjes s\u00eb kontrat\u00ebs. N\u00eb rast t\u00eb moskthimit t\u00eb pajisjeve n\u00eb afatin e parapar\u00eb, Operatori ka t\u00eb drejt\u00eb t\u00eb l\u00ebshoj\u00eb fatur\u00eb p\u00ebrkat\u00ebse me vler\u00ebn e pajisjeve dhe t\u00eb filloj\u00eb procedur\u00eb p\u00ebrmbarimore p\u00ebr ark\u00ebtimin e shum\u00ebs p\u00ebrkat\u00ebse.<\/p><p>8.3. P\u00ebrdoruesi \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr p\u00ebrdorim jo t\u00eb duhur t\u00eb pajisjeve, duke p\u00ebrfshir\u00eb por duke mos u kufizuar n\u00eb d\u00ebmtime fizike, furnizim jo i duhur me energji elektrike, ekspozim ndaj lag\u00ebshtis\u00eb, vendosje n\u00eb ambient pa qarkullim t\u00eb mir\u00eb t\u00eb ajrit, d\u00ebmtime t\u00eb kabllove n\u00eb hap\u00ebsirat q\u00eb jan\u00eb n\u00eb p\u00ebrgjegj\u00ebsi t\u00eb P\u00ebrdoruesit. N\u00eb t\u00eb gjitha k\u00ebto raste dhe n\u00eb \u00e7do rast tjet\u00ebr ku v\u00ebrtetohet p\u00ebrgjegj\u00ebsia e P\u00ebrdoruesit, P\u00ebrdoruesi obligohet t\u00eb kompensoj\u00eb d\u00ebmin n\u00eb p\u00ebrputhje me vler\u00ebn e faturuar nga Operatori. Kompensimi p\u00ebr pajisje nuk do t\u00eb tejkaloj\u00eb vler\u00ebn e tyre sipas parimit \u201cpro rata temporis\u201d (proporcionalisht me koh\u00ebn e mbetur).<\/p><p>8.4. In case the equipment is damaged by the User, he is obliged to pay the corresponding amount.<\/p><p>8.5. The type of equipment provided to the User is specified on the first page of this contract.<\/p><p>8.6. In case of theft of equipment, the User is obliged to submit an official report on the theft to the Kosovo Police.<\/p><p>8.7. P\u00ebrdoruesi \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr sigurin\u00eb e kompjuterit, pajisjet kompjuterike dhe t\u00eb dh\u00ebnat personale.<\/p><p>8.8. Operatori nuk b\u00ebn mir\u00ebmbajtje p\u00ebr pajisjet kompjuterike dhe rrjetin lokal (LAN cable) t\u00eb P\u00ebrdoruesit. P\u00ebr \u00e7do d\u00ebmtim q\u00eb rrjedh nga p\u00ebrdorimi jo i duhur i pajisjeve, Operatori nuk mban asnj\u00eb p\u00ebrgjegj\u00ebsi.<\/p><p>8.9. \u00c7mimi i sh\u00ebrbimit mbetet i pandryshuar, pavar\u00ebsisht n\u00ebse sh\u00ebrbimi ofrohet me pajisje t\u00eb p\u00ebrfshira apo jo. Asnj\u00eb pages\u00eb shtes\u00eb nuk do t\u00eb aplikohet p\u00ebr shkak t\u00eb p\u00ebrfshirjes ose mos p\u00ebrfshirjes s\u00eb pajisjeve n\u00eb sh\u00ebrbim.<\/p><ol start=\"9\"><li>Data Protection and Privacy<\/li><\/ol><p>9.1. Telkos, in full compliance with Law No. 06\/L-082 on Personal Data Protection, processes and stores the User's personal data, which includes name, surname, parent's name, personal number, postal address, telephone number, and email address.<\/p><p>9.2. The User, by signing this contract, agrees to have his\/her data processed by the Operator. The User is responsible for providing accurate data and informing the Operator within (5) five days in case of changes to this data.<\/p><p>9.3. The operator, in accordance with the legislation in force, cooperates with the competent law enforcement bodies and state authorities, providing necessary information according to official requests submitted in the form and manner prescribed by law.<\/p><p>9.4. By signing this contract, the User also agrees that personal data will be used by the Operator for the purpose of informing about obligations towards Telko as well as for marketing purposes, during the duration of this contract and after its termination.<\/p><ol start=\"10\"><li>Intellectual property<\/li><\/ol><p>10.1. Telkos is a licensed operator by the IMC for broadcasting. All channels on the Telkos platform are broadcast in full compliance with applicable legislation and in agreement with the rights holders.<\/p><p>10.2. Retransmission, republication, copying, storage or redistribution of the Operator's services is strictly prohibited.<\/p><ol start=\"11\"><li>Great Force<\/li><\/ol><p>11.1. In the event of failure to fulfill obligations resulting from force majeure, neither contracting party shall be liable. The Operator shall not be liable for any interruption or impairment of service caused by natural disasters, or by circumstances beyond the control of Telkos, which cannot be foreseen and prevented. In no case shall Telkos be liable for indirect damages, loss of income, caused to the User. Telkos shall not be liable for damages caused by electricity or lightning. Telcos are not liable for failure to fulfill obligations arising from events that are unforeseen, irresistible and beyond the control of the parties, such as failures due to weather, fire, acts of terrorism, war, riots, strikes or protests of workers, states of emergency, changes in laws and regulations, decisions by state bodies, cyberattacks, epidemics, failure of public infrastructure, damage to infrastructure by third parties, expropriation by the government, other acts of government or any event that is beyond the reasonable control of the relevant party.<\/p><p>\u00a0<\/p><ol start=\"12\"><li>Dispute resolution<\/li><\/ol><p>12.1. The supervisory bodies for the implementation of the contract are RAEPC (Regulatory Authority for Electronic and Postal Communications) and IMC (Independent Media Commission).<\/p><p>12.2. P\u00ebrdoruesi ka t\u00eb drejt\u00eb t\u00eb paraqes\u00eb ankes\u00eb me shkrim n\u00eb rast t\u00eb ndryshimit t\u00eb kushteve kontraktuale nga ana e Operatorit. Ankesa duhet t\u00eb d\u00ebrgohet n\u00eb form\u00eb elektronike n\u00eb adres\u00ebn zyrtare t\u00eb Operatorit: <a href=\"mailto:info@telkos.net\"><strong>info@telkos.net<\/strong><\/a>The User's written complaint must be submitted to <strong>Operator<\/strong> within fifteen (15) days from receipt of the invoice for the service provided, if the complaint refers to the amount invoiced for the service provided and within thirty (30) days from the provision of the service, if the complaint refers to the quality of the service provided.<\/p><p>12.3. The Operator is obliged to handle the User's complaints regarding channels within seven (7) days after receiving the complaint and the complaints regarding internet services within fifteen (15) days after receiving the complaint. Complaints related to the interruption of channel services must be handled no later than three (3) days from their submission.<\/p><p>12.4. N\u00eb rastet kur d\u00ebshton tentimi i pal\u00ebve p\u00ebr zgjidhjen e mosmarr\u00ebveshjeve p\u00ebrmes negociatave, pal\u00ebt mund t\u00eb iniciojn\u00eb n\u00eb ARKEP procedur\u00eb p\u00ebr zgjidhjen e mosmarr\u00ebveshjeve. N\u00ebse P\u00ebrdoruesi d\u00ebshiron t\u2019i drejtohet ARKEP me k\u00ebrkes\u00eb p\u00ebr zgjidhjen e mosmarr\u00ebveshjes me Operatorin ai duhet ta paraqes\u00eb k\u00ebrkes\u00ebn n\u00eb ARKEP, brenda pes\u00ebmb\u00ebdhjet\u00eb (15) dit\u00ebsh pas marrjes s\u00eb p\u00ebrgjigjes me shkrim nga Operatori.<\/p><p>12.5. N\u00ebnshkrimi i kontrates b\u00ebhet n\u00eb zyrat e Operatorit, por n\u00eb raste t\u00eb ve\u00e7anta, pal\u00ebt mund ta n\u00ebnshkruajn\u00eb edhe jasht\u00eb zyrave t\u00eb Operatorit ose n\u00eb distanc\u00eb, p\u00ebrmes mjeteve t\u00eb q\u00ebndrueshme t\u00eb komunikimit elektronik, me kusht q\u00eb t\u00eb p\u00ebrmbushen k\u00ebrkesat p\u00ebr informim dhe transparenc\u00eb t\u00eb parashikuara me legjislacionin n\u00eb fuqi.<\/p><p>1.3. Kontrata mund t\u00eb n\u00ebnshkruhet edhe n\u00eb m\u00ebnyr\u00eb elektronike, p\u00ebrmes \u00e7do forme t\u00eb identifikimit t\u00eb besuesh\u00ebm dhe konsiderohet ligj\u00ebrisht e vlefshme n\u00eb p\u00ebrputhje me Ligjin Nr. 08\/L-022 p\u00ebr Identifikimin Elektronik dhe Sh\u00ebrbimet e Besuara n\u00eb Transaksionet Elektronike.<\/p><ol start=\"2\"><li>Payments and Billing<\/li><\/ol><p>2.1. If the User does not fulfill the payment obligations within the specified deadlines, the services are terminated immediately, with warning, while the obligation continues in accordance with the contractual period, determined by this contract.<\/p><p>2.4. In the event that the competent authorities impose tariffs, taxes or other fiscal charges that affect the prices of services provided by the Operator, <strong>The user agrees to pay the additional amount applied.<\/strong>In these circumstances, the Operator has the right to <strong>increase the price of services only by the value of the imposed change<\/strong>, provided that the User is notified in advance, in accordance with the deadlines and procedures set forth in the applicable consumer protection legislation.<\/p><p>2.5. If the User changes the package, while having made a prepayment, and Telkos has fulfilled the terms of the contract, the remaining days of the prepayment are not compensated.<\/p><p>2.6. The operator considers them as <strong>service interruption<\/strong> only those defects that originate from its central infrastructure (backbone).<\/p><p>3.4. The User is obliged to provide unhindered physical access for the Operator's technical staff to the location where the Operator's equipment is located, for the purpose of inspection, maintenance and troubleshooting.<\/p><p>3.5. If the Operator's access to the equipment location is obstructed by third parties, the Operator shall not be liable for the interruption or inability to resolve the defect. The resolution of obstacles arising from third parties is the responsibility of the User.<\/p><ol start=\"4\"><li>Service Quality and Technical Defects<\/li><\/ol><p>4.1. N\u00ebse Operatori nuk p\u00ebrmbush obligimet p\u00ebr ofrimin e sh\u00ebrbimeve t\u00eb internetit dhe televizionit, kompensimi do t\u00eb b\u00ebhet sipas legjislacionit n\u00eb fuqi. Operatori ka t\u00eb drejt\u00eb t\u00eb nd\u00ebrmarr\u00eb masa t\u00eb menj\u00ebhershme dhe t\u00eb p\u00ebrkohshme p\u00ebr t\u00eb mbrojtur integritetin dhe sigurin\u00eb e rrjetit dhe sh\u00ebrbimeve, p\u00ebrfshir\u00eb, por pa u kufizuar n\u00eb:bllokimin e p\u00ebrkohsh\u00ebm t\u00eb trafikut nga ose drejt nj\u00eb adrese IP-je specifike q\u00eb dyshohet se \u00ebsht\u00eb burim i nj\u00eb sulmi kibernetik ose aktiviteti t\u00eb paligjsh\u00ebm si dhebllokimin e p\u00ebrkohsh\u00ebm t\u00eb aksesit drejt domeneve t\u00eb identifikuara si burim i p\u00ebrmbajtjes s\u00eb d\u00ebmshme ose aktivitetit t\u00eb paligjsh\u00ebm.<\/p><ol start=\"6\"><li>User Rights and Obligations<\/li><\/ol><p>6.1. The User is obliged to use the services provided by the Operator in accordance with the terms of this contract and the applicable legislation. The User agrees to use the service only for personal, residential purposes. Any use of the service for business purposes constitutes a serious breach of the contractual terms.<\/p><p>In case of violation, Telkos may warn the User to use the service in accordance with the terms of the contract, suspend or automatically cancel the service provided by Telkos without any obligation for compensation to the User and request compensation for damages caused by the misuse made by the User. If the contract is canceled by Telkos for reasons provided for in this article, the User remains liable for all remaining financial obligations to the Operator.<\/p><p>6.2. Any persistent or repeated discrepancy between the actual quality of the User's service and the standards set out in the contract, entitles the User to take legal measures, in accordance with the legislation in force. The User must inform Telkos of the discrepancy. If Telkos does not rectify the discrepancy within 15 days, the User has the right to file a complaint with the RAEPC (Regulatory Authority for Electronic and Postal Communications).<\/p><p>6.3. P\u00ebr zhvendosjen e sh\u00ebrbimit brenda s\u00eb nj\u00ebjt\u00ebs nj\u00ebsi, aplikohet tarif\u00eb prej pes\u00eb (5) \u20ac. Telkos nuk mban p\u00ebrgjegj\u00ebsi n\u00ebse sinjali nuk \u00ebsht\u00eb i disponuesh\u00ebm n\u00eb adres\u00ebn e re t\u00eb P\u00ebrdoruesit.<\/p><p>6.4. Removal or interruption of the transmission of channels whose content is contrary to the constitutional order, in accordance with decisions of the competent authorities, does not constitute a reason for unilateral termination of the contract by the User.<\/p><ol start=\"7\"><li>Hyrja n\u00eb fuqi, koh\u00ebzgjatja dhe nd\u00ebrprerja e kontrat\u00ebs<\/li><\/ol><p>7.1. Kjo kontrat\u00eb hyn dhe mbetet n\u00eb fuqi p\u00ebr periudh\u00ebn e caktuar n\u00eb faqen e par\u00eb t\u00eb saj. Kontrata parashikon zgjatje automatike, me njoftim tridhjet\u00eb (30) dit\u00eb p\u00ebrpara. Pas nj\u00eb zgjatjeje t\u00eb till\u00eb P\u00ebrdoruesi ka t\u00eb drejt\u00eb t\u00eb p\u00ebrfundoj\u00eb kontrat\u00ebn n\u00eb \u00e7do koh\u00eb, me nj\u00eb afat njoftimi prej s\u00eb paku pes\u00eb (5) dit\u00ebsh para dat\u00ebs s\u00eb p\u00ebrfundimit, pa kosto shtes\u00eb.<\/p><p>7.2. Kontrata mund t\u00eb nd\u00ebrpritet n\u00eb rast t\u00eb mosrespektimit apo shkeljeve t\u00eb\u00a0 kushteve t\u00eb saj nga cilado pal\u00eb. Nd\u00ebrprerja e kontrat\u00ebs n\u00eb munges\u00eb t\u00eb provave t\u00eb qarta dhe v\u00ebrejtjeve t\u00eb dh\u00ebna me shkrim nga pal\u00ebt konsiderohet e paligjshme.<\/p><p>7.3. N\u00ebse P\u00ebrdoruesi e nd\u00ebrpret kontrat\u00ebn me afat t\u00eb caktuar para periudh\u00ebs kohore t\u00eb r\u00ebn\u00eb dakord, ofruesi i sh\u00ebrbimit mund t\u00eb k\u00ebrkoj\u00eb kompensim p\u00ebr p\u00ebrfundimin e parakohsh\u00ebm t\u00eb kontrat\u00ebs gjat\u00eb n\u00ebnt\u00eb (9) muajve t\u00eb par\u00eb kur kontrata \u00ebsht\u00eb lidhur p\u00ebr dymb\u00ebdhjet\u00eb (12) muaj, p\u00ebrkat\u00ebsisht dymb\u00ebdhjet\u00eb (12) muajt e par\u00eb kur kontrata \u00ebsht\u00eb lidhur p\u00ebr nj\u00ebzet e kat\u00ebr (24) muaj.<\/p><p>7.4. N\u00ebse P\u00ebrdoruesi ka abonim dhe nuk e ka shfryt\u00ebzuar sh\u00ebrbimin, nuk ka t\u00eb drejt\u00eb t\u00eb k\u00ebrkoj\u00eb kompensim p\u00ebr periudh\u00ebn e pashfryt\u00ebzuar.<\/p><p>7.5. P\u00ebrdoruesi ka t\u00eb drejt\u00eb t\u00eb shk\u00ebpus\u00eb kontrat\u00ebn pa kosto shtes\u00eb n\u00ebse Telkos ka d\u00ebshtuar t\u00eb p\u00ebrmbush\u00eb kushtet e kontrat\u00ebs, ka nd\u00ebrprerje t\u00eb platformave t\u00eb ndryshme brenda Telkos, gjegj\u00ebsisht nuk mund t\u00eb ofroj\u00eb sh\u00ebrbime sipas kontrat\u00ebs q\u00eb jan\u00eb pajtuar pal\u00ebt, p\u00ebrve\u00e7 n\u00ebse ndryshimet e propozuara jan\u00eb n\u00eb dobi t\u00eb P\u00ebrdoruesit, jan\u00eb t\u00eb nj\u00eb natyre administrative, nuk kan\u00eb efekt negativ te P\u00ebrdoruesi si dhe vendosen drejtp\u00ebrdrejt nga ligji ose vendimet e organeve shtet\u00ebrore. <strong>K\u00ebrkesa e P\u00ebrdoruesit<\/strong> duhet t\u00eb mb\u00ebshtetet me d\u00ebshmi t\u00eb paraqitura nga vet\u00eb P\u00ebrdoruesi, nd\u00ebrsa gjendja faktike e sh\u00ebrbimeve duhet t\u00eb konstatohet dhe verifikohet nga Operatori. Vet\u00ebm pas konstatimit dhe verifikimit nga Operatori, P\u00ebrdoruesi mund t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn p\u00ebr shk\u00ebputjen e kontrat\u00ebs pa kosto shtes\u00eb. T\u00eb gjitha ndryshimet e propozuara nga Telkos do t\u2019i d\u00ebrgohen P\u00ebrdoruesit t\u00eb pakt\u00ebn tridhjet\u00eb (30) dit\u00eb para hyrjes n\u00eb fuqi t\u00eb atyre ndryshimeve. N\u00ebse P\u00ebrdoruesi nuk pajtohet me ndryshimet ka t\u00eb drejt\u00eb t\u00eb nd\u00ebrpres kontrat\u00ebn brenda dy (2) muajve pas ndryshimeve. N\u00eb k\u00ebt\u00eb rast ai obligohet t\u00eb njoftoj\u00eb Telkos dhe t\u00eb paguaj\u00eb detyrimin e papaguar p\u00ebr sh\u00ebrbimin e marr\u00eb deri n\u00eb dat\u00ebn e shk\u00ebputjes s\u00eb kontrat\u00ebs.<\/p><p>7.6. N\u00ebse P\u00ebrdoruesi e nd\u00ebrpret kontrat\u00ebn para periudh\u00ebs kohore t\u00eb p\u00ebrcaktuar me kontrat\u00eb, kur Telkos ka ofruar sh\u00ebrbim n\u00eb p\u00ebrputhje me kushtet e kontrat\u00ebs, P\u00ebrdoruesi obligohet t\u00eb paguaj\u00eb tarif\u00ebn e shk\u00ebputjes s\u00eb parakohshme n\u00eb vler\u00eb prej 50\u20ac p\u00ebr shk\u00ebputjet n\u00eb gjasht\u00eb mujorin e par\u00eb t\u00eb kontrat\u00ebs 12 mujore dhe 30\u20ac p\u00ebr shk\u00ebputjet n\u00eb tremujorin e tret\u00eb t\u00eb kontrat\u00ebs dymb\u00ebdhjet\u00eb mujore. N\u00eb t\u00eb kund\u00ebrt\u00ebn Telkos do t\u00eb inicioj\u00eb procedur\u00eb p\u00ebrmbarimore p\u00ebrmes p\u00ebrmbaruesit privat. T\u00eb gjitha shpenzimet e krijuara me k\u00ebt\u00eb rast do t\u2019i bart\u00eb P\u00ebrdoruesi.<\/p><p>7.7. The equipment installed by the Operator for use is the property of the Operator, loaned to the User, for the period of use under this contract, unless the User expresses a willingness to purchase such equipment. The price of the modem is sixty (60) \u20ac, the price of the receiver is sixty (60) \u20ac.<\/p><p>8.2. P\u00ebrdoruesi \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr p\u00ebrdorim jo t\u00eb duhur t\u00eb pajisjeve, duke p\u00ebrfshir\u00eb por duke mos u kufizuar n\u00eb d\u00ebmtime fizike, furnizim jo i duhur me energji elektrike, ekspozim ndaj lag\u00ebshtis\u00eb, vendosje n\u00eb ambient pa qarkullim t\u00eb mir\u00eb t\u00eb ajrit, d\u00ebmtime t\u00eb kabllove n\u00eb hap\u00ebsirat q\u00eb jan\u00eb n\u00eb p\u00ebrgjegj\u00ebsi t\u00eb P\u00ebrdoruesit. N\u00eb t\u00eb gjitha k\u00ebto raste dhe n\u00eb \u00e7do rast tjet\u00ebr ku v\u00ebrtetohet p\u00ebrgjegj\u00ebsia e P\u00ebrdoruesit, P\u00ebrdoruesi obligohet t\u00eb kompensoj\u00eb d\u00ebmin n\u00eb p\u00ebrputhje me vler\u00ebn e faturuar nga Operatori. In case the equipment is damaged by the User, he is obliged to pay the corresponding amount.<\/p><p>8.5. The type of equipment provided to the User is specified on the first page of this contract.<\/p><p>8.6. In case of theft of equipment, the User is obliged to submit an official report on the theft to the Kosovo Police.<\/p><p>8.7. P\u00ebrdoruesi \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr sigurin\u00eb e kompjuterit, pajisjet kompjuterike dhe t\u00eb dh\u00ebnat personale.<\/p><p>8.8. Asnj\u00eb pages\u00eb shtes\u00eb nuk do t\u00eb aplikohet p\u00ebr shkak t\u00eb p\u00ebrfshirjes ose mos p\u00ebrfshirjes s\u00eb pajisjeve n\u00eb sh\u00ebrbim.<\/p><ol start=\"9\"><li>Data Protection and Privacy<\/li><\/ol><p>9.1. Telkos, in full compliance with Law No. 06\/L-082 on Personal Data Protection, processes and stores the User's personal data, which includes name, surname, parent's name, personal number, postal address, telephone number, and email address.<\/p><p>9.2. The User, by signing this contract, agrees to have his\/her data processed by the Operator. The User is responsible for providing accurate data and informing the Operator within (5) five days in case of changes to this data.<\/p><p>9.3. The operator, in accordance with the legislation in force, cooperates with the competent law enforcement bodies and state authorities, providing necessary information according to official requests submitted in the form and manner prescribed by law.<\/p><p>9.4. By signing this contract, the User also agrees that personal data will be used by the Operator for the purpose of informing about obligations towards Telko as well as for marketing purposes, during the duration of this contract and after its termination.<\/p><ol start=\"10\"><li>Intellectual property<\/li><\/ol><p>10.1. Telkos is a licensed operator by the IMC for broadcasting. All channels on the Telkos platform are broadcast in full compliance with applicable legislation and in agreement with the rights holders.<\/p><p>10.2. Retransmission, republication, copying, storage or redistribution of the Operator's services is strictly prohibited.<\/p><ol start=\"11\"><li>Great Force<\/li><\/ol><p>11.1. In the event of failure to fulfill obligations resulting from force majeure, neither contracting party shall be liable. The Operator shall not be liable for any interruption or impairment of service caused by natural disasters, or by circumstances beyond the control of Telkos, which cannot be foreseen and prevented. In no case shall Telkos be liable for indirect damages, loss of income, caused to the User. Telkos shall not be liable for damages caused by electricity or lightning. Telcos are not liable for failure to fulfill obligations arising from events that are unforeseen, irresistible and beyond the control of the parties, such as failures due to weather, fire, acts of terrorism, war, riots, strikes or protests of workers, states of emergency, changes in laws and regulations, decisions by state bodies, cyberattacks, epidemics, failure of public infrastructure, damage to infrastructure by third parties, expropriation by the government, other acts of government or any event that is beyond the reasonable control of the relevant party.<\/p><ol start=\"12\"><li>Dispute resolution<\/li><\/ol><p>12.1. The supervisory bodies for the implementation of the contract are RAEPC (Regulatory Authority for Electronic and Postal Communications) and IMC (Independent Media Commission).<\/p><p>12.2.
